Waybill
Für internationale Seetransporte arbeiten wir auf Grundlage der Bedingungen des “K” Line European Sea Highway Services GmbH Waybill. Die Bedingungen des Waybill finden Sie hier. Nach diesen Bedingungen unterliegt unsere Haftung dem englischen Recht. Für Streitigkeiten ist der High Court of Justice in London zuständig, sofern von uns nicht ein anderes im Zusammenhang mit dem Seetransport zuständiges Gericht gewählt wird.

Haftung
Für multimodale Transporte unter Einschluss der Seebeförderung ist unsere Haftung auf zwei Sonderziehungsrechte des internationalen Währungsfonds (IWF) pro Kilogramm des beförderten Gutes beschränkt.

ADSp
Für speditionelle Leistungen im Zusammenhang mit dem Transport arbeiten wir ausschließlich auf Grundlage der "Allgemeinen Deutschen Spediteurbedingungen (ADSp)", jeweils neueste Fassung. Diese beschränken in § 23 ADSp die gesetzliche Haftung für Güterschäden abweichend von § 431 HGB auf € 5,00 pro Kilogramm sowie ferner je Schadensfall € 1 Million bzw. je Schadensereignis auf € 2 Millionen oder zwei Sonderziehungsrechte des IWF pro Kilogramm je Schadensfall bzw. Schadensereignis, je nachdem, welcher Betrag höher ist.

Agenturtätigkeiten
Für Agenturtätigkeiten im Zusammenhang mit der Vertretung anderer Reedereien arbeiten wir ausschließlich nach den "Allgemeinen Geschäftsbedingungen für Schiffsmakler und Schiffsagenten innerhalb der Bundesrepublik Deutschland".

Gerichtsstand
Gerichtsstand und Erfüllungsort bei multimodalen Transporten, speditionellen Tätigkeiten sowie Agenturleistungen ist Hamburg.

Waybill
In respect of international sea transports, the terms and conditions of the “K” Line European Sea HighwayServices GmbH Waybill shall apply exclusively. The terms and conditions of this Waybill can be found here. According to these terms and conditions our liability is subject to English law. Any dispute shall be referred to the High Court of Justice in London, which shall have sole jurisdiction unless we choose another court competent in connection with the respective sea transport.

Liability
In respect of multimodal transport including asea voyage, our liability is limited to 2 Special Drawing Rights (SDR) of the International Monetary Fund (IMF) per kilogram of the goods carried.

German General Terms and Conditions of Freight Forwarders
In respect of freight forwarding services in connection with any transport, we work exclusively on the basis of the German General Terms and Conditions of Freight Forwarders (Allgemeine Deutsche Spediteurbedingungen -ADSp) in their respective newest edition. Section 23 thereof limits the statutory liability for loss of or damage to goods in derogation of §431 of the German Commercial Code (Handelsgesetzbuch -HGB) to € 5,00 per kilogram, and further to € 1 million per loss/damage and to € 2 million per incident, or to 2 SDR of the IMF per kilogram per loss/damage and incident, whichever is greater.

Agency Services
In respect of ship agency services, we work exclusively on the basis of the General Business Conditions for Ship Brokers and Ship Agents in the Federal Republic of Germany" (Allgemeinen Geschäftsbedingungen für Schiffsmakler und Schiffsagenten innerhalb der Bundesrepublik Deutschland).

Place of Jurisdiction
In respect of multimodal transports, freight forwarding and ship agency services, the place of jurisdiction and place of performance is Hamburg, Germany
